Jakarta Company Registration: Restaurant Licenses

Jakarta Company Registration: Restaurant Licenses

The restaurant business is one of the sectors that have the potential to grow in Indonesia, especially in big cities such as Jakarta and Bali.

The McKinsey Global Institute stated that 90 million new Indonesians are likely to join the consuming class, making it as big as about 135 million by 2030. This will significantly influence the increase in Indonesians’ purchasing power as Indonesians transition to the consuming class.  The middle community has started to adopt a lifestyle where social branding also plays an important role in addition to basic needs. Therefore, the value of consumption in the retail sector, especially the restaurant, will also experience a significant increase.

Suppose you are planning to open a restaurant business in Jakarta. In that case, this article will aid you with a complete comprehension of how to set up a fully-established restaurant according to Indonesian business policy.

Which regulation should Restaurant Business refer to?

Formerly, the food and drink service business was referred to as a tourism business. The owner may refer the regulations to the Ministerial Regulation of the Ministry of Culture and Tourism No. PM. 87 /HK.501/MKP/2010.

However, in response to the OSS Regulation, the Ministry of Culture and Tourism issued an updated regulation under the Minister of Culture and Tourism Regulation No. 10 of 2018. The essence is concerning Integrated Business Licensing E-Service in the Tourism Sector (“Tourism OSS Regulation”).

Who is allowed to obtain a Restaurant License?

Essentially, anyone with a legal entity established under Indonesian Law can obtain a Restaurant License.

The country welcomes either local or foreign investors entering the restaurant business. Opening a restaurant is very much similar to doing another Company Registration in Indonesia. Founders must set up the type of investment they would like to select according to the investors’ statuses. Direct investment in a Limited Liability Company (PT) will be perfect for local investors. Meanwhile, foreigners who want to open a restaurant business in Jakarta and are willing to be direct shareholders can choose to register a PMA (Penanaman Modal Asing) or a Foreign-Owned Company.

Through the 2018 regulation, the Indonesian government implemented the Online Single Submission (OSS) system for companies or individuals who want to apply for a business license.

to obtain a Restaurant License is no different. You need to register your business as a Company under Indonesian Law, then you have to get access to the OSS system first.

This can be done through the portal provided by the government which requires you to provide some essential documents about your business.

After obtaining a TDUP, you must also apply for a Certificate of Good Health or SLS. Both documents are the main requirements to obtain a Business License Number (NIB).
